Welcome to ReFuel Athletics. These Terms of Use ("Terms") govern your use of our website at refuelgel.com and any related services we offer (collectively, the "Service"). By accessing the Service, creating an account, or joining our waitlist, you agree to these Terms.

ReFuel Athletics is in pre-launch development. The Service is currently provided for informational purposes and to allow interested customers to join a waitlist for our forthcoming products. No products are available for purchase at this time.

1. Who we are

ReFuel Athletics is a sports nutrition company based in Utah, United States. We are developing custom energy gel products and related hardware for endurance athletes. References to "ReFuel," "we," "us," and "our" mean ReFuel Athletics and its operators.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By creating an account or joining the waitlist, you confirm that the information you provide is accurate and that you are authorized to provide it.

3. Accounts and the waitlist

You can use the Service without an account. If you create an account, you agree to keep your password confidential, to be responsible for all activity under your account, and to notify us promptly of any unauthorized use. We use Supabase Auth to handle authentication; your password is hashed and never stored or transmitted by us in plain text.

If you join our waitlist, you are providing your email address (and optionally your name) so that we can contact you about our launch and provide you with a personal discount code. You can ask us to remove your information at any time by emailing haydenh.refuel@gmail.com.

4. Waitlist discount codes

Each waitlist signup is issued a unique single-use discount code via email. The code is intended for the email address it was sent to, may only be used once, and may be revoked at any time before redemption. Codes are not currency and have no cash value. We reserve the right to limit, modify, or terminate the waitlist promotion at any time.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to access, scrape, or interfere with parts of the Service not made available to you
• Create multiple waitlist accounts to claim extra discount codes
• Impersonate another person or sign up using someone else's email
• Post abusive, harassing, infringing, or otherwise harmful content in the community section
• Attempt to reverse-engineer, copy, or distribute our content, code, or design

6. User-submitted content

Our Service may allow you to submit content such as gel formulas, profile information, and community posts. You retain ownership of your content. By submitting it, you grant ReFuel a non-exclusive, worldwide, royalty-free license to host, display, and use your content as necessary to operate the Service. We may remove content at any time if we believe it violates these Terms.

7. Health disclaimer

Information on this Service about sports nutrition, energy gels, carbohydrate intake, caffeine, and electrolytes is provided for general informational purposes only. It is not medical or nutritional advice. Always consult a qualified healthcare provider before starting any nutrition program, especially if you are pregnant, nursing, taking medication, or have a medical condition. ReFuel products are intended for healthy adult athletes.

8. Intellectual property

The Service and its original content (excluding user-submitted content), including the ReFuel name and logo, branding, design, and software code, are and remain the exclusive property of ReFuel Athletics and its licensors.

9. Third-party services

The Service relies on third-party providers including Supabase (account and data storage), Vercel (hosting), Stripe (payment processing), Google (Gmail for transactional email), and Anthropic Claude (AI support chat). Your use of these features is subject to those providers' own terms and privacy policies.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including if we believe you have violated these Terms. You may stop using the Service or delete your account at any time by emailing us.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, REFUEL ATHLETICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, WHICHEVER IS GREATER.

13. Governing law

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Salt Lake County, Utah.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. If the changes are material, we'll make a reasonable effort to notify you (for example, by email or a notice on the Service). Continuing to use the Service after changes take effect constitutes your acceptance of the updated Terms.
